Terms of Use
These Terms are an agreement between you and Eat. Win. Now. ("we," "us"). By using eatwinnow.com or app.eatwinnow.com (the "Services"), you agree to these Terms and to our Privacy Policy.
1. Who can use the Services
You must be at least 18 years old. The Services are for parents, coaches, team organizers and other adults arranging group meals, not for children. In the Team Meal Organizer, enter only a player's first name and optional jersey number, and only what's needed for a meal.
2. What we do
We're a free referral and booking-coordination service. We help you find restaurants near your event and pass your group's request to a local restaurant, and the Team Meal Organizer helps your team split up meals. We are not a restaurant or delivery service. Each restaurant is an independent business that sets its own menu, prices, availability and policies, and it alone is responsible for its food and service. A request is booked only when the restaurant confirms it. Restaurants may accept or decline any request.
3. How we make money
Eat. Win. Now. is free for teams, parents and coaches, and you never pay us a booking fee. We help your team book group meals at local restaurants, at no cost to your team. You pay the restaurant directly for your meal. We charge restaurants 1.5% of the pre-tax food and drink total, only for groups we send them that actually dine, with no minimums and no fee for no-shows, cancellations or fully refunded bills.
To remove your restaurant's listing, send a request through the restaurant form on this site or reply to any email from us. We aim to remove it within 2 business days of your request. Bookings made before removal are still handled under your partner agreement.
4. Not affiliated with tournaments or venues
We name tournaments, events, leagues, venues and restaurants only to identify them. Eat. Win. Now. is independent and is not affiliated with, sponsored by or endorsed by any tournament, event organizer, league, venue or facility, or by any restaurant except our partners. Event names, dates and locations come from public listings and may be wrong or change, so always check with your event organizer. Restaurant details such as hours and ratings may come from third-party map services, so confirm them with the restaurant.
5. Food, allergies and safety
Confirm food allergies and dietary needs directly with the restaurant. We pass along any notes you give us exactly as written, but we don't prepare food, we can't guarantee that any meal is free of allergens, and we aren't responsible for ingredients, food preparation, cross-contact, food safety, alcohol service or the restaurant's premises. Adults are responsible for supervising minors at meals.
6. Payments between team members
The Team Meal Organizer can show an organizer's Venmo username and a suggested amount, and it lets the organizer mark meals "paid." Payments happen directly between team members through Venmo or other services you choose. We don't process, receive or hold any funds, we aren't a party to those payments, and we can't refund, reverse or resolve them. Venmo's own terms govern your use of Venmo.
7. Your account and team pages
You sign in with one-time links we email you. Keep your email account and your organizer link secure, because anyone with the organizer link can manage the team page. You're responsible for the information you enter. Organizers can delete a team page at any time, which deletes its roster, claims and dietary notes.
8. Acceptable use
Don't misuse the Services. That includes false bookings, impersonating someone, entering other people's emails without permission, sending spam through sign-in emails, scraping, interfering with security, and posting unlawful, harassing or offensive content. We may suspend access or remove content that breaks these Terms.
9. Our content
The Services, including the Eat. Win. Now. name and logo, belong to us. You may use them only to use the Services. Third-party names and marks belong to their owners.
10. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that any restaurant will accept, fulfill or properly prepare a booking, that event or restaurant information is accurate, or that the Services will be uninterrupted or error-free.
11. Limitation of liability
To the fullest extent the law allows, Eat. Win. Now. and its owners won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. We also won't be liable for illness, injury, allergic reaction, loss or damage caused by food, restaurants, venues, payment services or other third parties. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some laws don't allow these limits, so they may not fully apply to you.
12. Indemnity
If your misuse of the Services or your violation of these Terms causes a claim against us, you agree to cover our reasonable losses and costs from it.
13. Governing law and disputes
Texas law governs these Terms, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts in Travis County, Texas, and you and we consent to those courts. Either side may bring a qualifying claim in small-claims court. Before filing a claim, please contact us through eatwinnow.com so we can try to resolve it informally.
14. Changes and termination
We may update these Terms by posting them here with a new effective date. If you keep using the Services after an update, you accept the new Terms. You can stop using the Services at any time, and we may suspend or end access for violations. Sections 3–5 and 9–13 continue to apply after you stop.
15. General
If any part of these Terms is unenforceable, the rest stays in effect. If we don't enforce a term, we haven't waived it. These Terms and the Privacy Policy are the entire agreement between you and us about the Services. Restaurants that join get a written partner agreement by email after signup. Nothing is binding until the restaurant accepts it.
